The legal problems occur once the extracts contain higher percentages of THC, or when they’re made from cannabis plants that are no longer considered “hemp” (so basically high THC plants). Products with these extracts might be in violation of the United States Controlled Substances Act (US CSA). This is when laws regarding specific states or countries will apply.
Most hemp producers cite the 2014 Farm Bill as evidence their business is legal. In it is a provision that allows people to cultivate hemp for research purposes under pilot programs connected to universities or state agricultural departments. The bill defines “industrial hemp” as any part of the cannabis plant with less then 0.3 percent THC. Forty states have passed legislation authorizing pilot programs, and 19 of those states have active programs, cultivating and researching hemp under the guidelines.
Because CBD oil products are mostly unregulated, there’s no guarantee that any given product contains a safe or effective level of CBD. In fact, a study published in the Journal of the American Medical Association in 2017 found that nearly 70 percent of all CBD products sold online are incorrectly labeled, and could cause serious harm to consumers. Some CBD oils may also contain incorrectly labeled amounts of THC and other compounds.
Within the cannabis industry, CBD products have become a hot commodity, with some companies using hemp-derived sources to extract CBD in order to stay on the right side of federal law. Just how much CBD is contained in hemp isn’t clear however. There isn’t much in the stalks and seeds of the cannabis plant, but breeders have been developing hemp and marijuana strains with “high CBD” content and extracting CBD from plants in the form of concentrated oils. In states where they’re legal, CBD products are increasingly popular and are often included as an additive to beverages and other food products.

Inhaling cannabis may involve minor issues due to the combustion process, while using cannabis oil does not result in the same effects since it does not require being heated. Since its benefits can be enjoyed without smoking, the remedy is often considered for children with severe health conditions, like epilepsy. Smokers may want to consider a vaporizer for whole-plant cannabis consumption.
