On Apr. 9, 2014, the House Public Safety Committee passed a CBD oil bill by a 13-5 margin. The legislation, already been approved by the Senate, is strictly intended for patients with epilepsy or other seizure disorders. It allows for possession of a six-months supply (32 ounces) and calls for the University of Iowa to conduct a CBD study. Patients will need to go out-of-state (presumably to Colorado) to acquire the oil. Gov. Terry Branstad signed the bill into law on May 30, 2014.

• What's the dosing? This is a confusing one for many people. “The DEA makes it clear they don’t have to explicitly list anything as a controlled substance as long as a substance is intended for human ingestion, not approved as a drug by the (US Food and Drug Administration), or is structurally or pharmacologically similar to another controlled substance,” he told Leafly. “This DEA rulemaking change doesn’t make it any more illegal” than it previously was. The new rule “was an administrative change,” Armentano added. “It has nothing to do with law enforcement.”

Despite all these challenges, if you know what you're buying, hemp-derived CBD oil as a product itself is not illegal.
CBD was first discovered in 1940 by Roger Adams, a prominent organic chemist at the University of Illinois. Shortly thereafter, other scientists began testing isolated cannabinoids on lab animals; notably, Walter S. Loewe ran trials on mice and rabbits with the cannabinoids THC, CBD and CBN. He found that CBD produced no observable effects in the animals’ behavior while THC caused, what he called, a “central excitant action” in rabbits. Despite the prevalence of mental health disorders remaining unchanged during this period, the number of patients seeking treatment for mental disorders increased threefold.

In 2015, The Hebrew University of Israel published a study that documented the potency of single-molecule CBD extract versus the potency of whole-plant CBD-rich extract. It found that extract taken from whole plant CBD-rich cannabis is therapeutically superior to single-molecule extract. The scientists behind this study noticed that science had been utilizing pure, single-molecule CBD, which resulted in a bell-shaped dose-response curve. This means that CBD’s efficacy plummets at very high and very low doses.
In 2014, the Alabama state legislature passed SB 174, a restrictive cannabidiol (CBD) law. Officially entitled "Carly's Law," it offers an affirmative defense for the possession and use of CBD; however, the program is extremely limited and may not be able to provide CBD-rich medicine to patients in Alabama. In 2016, HB 61 was passed, which expanded the affirmative defense to several conditions and removed the requirement that patients must be enrolled in the UAB study program.

The DSM and then ICD adopted new criteria-based classifications, and the number of "official" diagnoses saw a large expansion. Through the 1990s, new SSRI-type antidepressants became some of the most widely prescribed drugs in the world, as later did antipsychotics. Also during the 1990s, a recovery approach developed.

After realizing that simply changing the location of mental health care from the state hospitals to nursing houses was insufficient to implement the idea of deinstitutionalization, the National Institute of Mental Health in 1975 created the Community Support Program (CSP) to provide funds for communities to set up a comprehensive mental health service and supports to help the mentally ill patients integrate successfully in the society. People who were temporally hospitalized were also provided aid and care and a pre-release program was created to enable people to apply for reinstatement prior to discharge. Not until 1990, around 35 years after the start of the deinstitutionalization, did the first state hospital begin to close. The number of hospitals dropped from around 300 by over 40 in the 1990s, and finally a Report on Mental Health showed the efficacy of mental health treatment, giving a range of treatments available for patients to choose.

While it’s true that CBD is legal in all 50 states, there are situations when it isn’t legal. The difference between legal and illegal typically depends on several important factors determined by the state in question. There is, however, one very important factor that is a crucial determinant across all states, and that is where the CBD is derived from–hemp or marijuana.
In a small study published in the journal JCI Insight in 2017, researchers observed that CBD may help prevent stress-related changes in blood pressure. For the study, nine healthy male volunteers took a single dose of either CBD or placebo. Compared to those given the placebo, those treated with CBD had lower blood pressure both before and after experiencing a stressful event.
Along with its better-known counterpart, THC (delta-9-tetrahydrocannabinol, the chemical that produces the marijuana high), CBD is one of more than 400 compounds found in the oils of cannabis plant species, which include marijuana and hemp. Unlike THC, CBD will not make you high. That said, this doesn’t mean CBD is not at all psychoactive, as many assert, says Jahan Marcu, Ph.D., director of experimental pharmacology and behavior at the International Research Center on Cannabis and Mental Health in New York City: “CBD does change cognition. It affects mood, which is why people take it for anxiety. And some find that it makes them more alert.”
In a recent federal court case, a three-judge panel on the Ninth Circuit sided with the DEA and ruled against the Hemp Industries Association after the agency established a new drug code for “marihuana extract” in 2016. The ruling means that CBD remains a controlled substance. Garrett Graff, the attorney representing the hemp industry in the case, told me that the court opinion did make an exception for Farm Bill hemp, and that it was “not subject to DEA authority,” he said.

Hemp producers who sell CBD products will often use the 2014 Farm Bill to claim that it is legal.
