I am confused. Is there a difference between "dietary supplements" and "supplements" - this distinction appears to be made here in the review as to legality? Or is this reference to legality only referring to the difference between industrial hemp derived CBD and the medical marijuana controlled plant? I've noticed an explosion of CBD products, hemp oils, etc. in the last few months, advertising on social media, etc. and I've read from other articles that CBD extracted from industrial hemp, if isolated properly, is no different molecularly or in effects, than that extracted from the marijuana plant, and that the CBD extracted from hemp IS legal in all 50 states. Could you clarify in a more obvious way these subtle points. Is the FDA moving to even restrict CBD isolated from industrial hemp, or only from the marijuana plant?
Georgia’s law is much more limited than some other states’ medical marijuana laws. For example, it does not legalize the sale or possession of marijuana in leaf form, and it does not authorize retail stores to sell marijuana or products made from the marijuana plant. It does not authorize physicians to prescribe marijuana for medical use. It is intended solely to protect qualified persons from criminal prosecution for possessing low THC oil for medicinal purposes.
We use ethanol/alcohol to extract our hemp, the most historically used method for cannabis/hemp extracts. Cannabidiol (CBD) is a compound derived from cannabis (a hemp plant also known as marijuana). However, unlike other compounds found in cannabis, such as THC, cannabidiol is not believed to be a psychoactive compound affecting perception, and behavior. Preliminary evidence suggests CBD may modestly reduce anxiety, certain measures of dystonia (a movement disorder), and glaucoma (Health Canada 2013).

Under federal law, cannabis (from which both CBD and marijuana are derived) is illegal everywhere, although the laws against it aren’t generally enforced in states that have legalized marijuana. Hemp is a variety of the Cannabis sativa plant that is grown specifically for industrial purposes. For millennia, people have used hemp fibers from the stalks and stems of the plant to make rope, textiles, paper, and many other products and have also used its seeds (and the oil from the seeds) as a food source. In the US however, heavy regulation and taxation of hemp dating back to the Marihuana Tax Act of 1937 and subsequently through the Controlled Substances Act of 1970 all but rendered hemp farming in the US a legal impossibility for most of the past century.
And without high-quality trials, experts don’t know how much is best for a given purpose. The staff at Roth’s dispensary told her, “Try some once or twice a day and see what happens.” (Half a dropper’s worth was a good amount for her.) One thing scientists feel confident about is that CBD is not dangerous. It won’t damage vital organs even at doses as high as 5,000 mg a day, Marcu says, and nobody has died from simply overdosing on a cannabis product.
Some states only allow for products infused with CBD, some only allow for high-CBD and low-THC products, while others allow both THC and CBD. To further confuse the American citizenry, some states permit patients the use of CBD, but require that they travel to another state to purchase it. So even though hemp oil and CBD oil come from the same genus and species (Cannabis sativa), hemp oil is derived from a strain that has a very low cannabinoid count (more on that later). CBD oil, on the other hand, is derived from the strains you can find in your local dispensary. Many growers refer to the hemp plant as a cousin of the plant that produces your Fruity Pebbles and your Yoda OG.
As of 2018, there are a total of 46 states (including the 8 states mentioned above) where CBD is legal with a prescription for medicinal usage. Now although CBD usage is for legal in these states, the law varies from state to state, with 17 states having specific legislation for the THC-levels found in CBD and the conditions being treated with CBD.
The tricky part is that there's some evidence suggesting CBD works best for pain when combined with a little THC, says Dr. Danesh. "Depending on what type of pain you have, you might be able to do just CBD, but sometimes you need CBD and THC." This makes accessing a product that will actually help you more difficult due to different regulations in each state. In New York, where Dr. Danesh practices, for example, CBD is available over the counter. But as soon as you add THC, you need a prescription.
Over decades, researchers have found that THC may help treat pain, nausea, loss of appetite and other problems, while CBD was thought to be biologically inactive in humans. But in the past 10 years, scientists have concluded that CBD may be quite useful. Dozens of studies have found evidence that the compound can treat epilepsy as well as a range of other illnesses, including anxiety, schizophrenia, heart disease and cancer.
Hemp being federally legal would be huge for the CBD industry, as CBD oil made from hemp extract (a plant that has very low amounts of THC) would be legal. A new, more available form of CBD would also allow for more research on the subject of cannabidiol, and perhaps the entire marijuana plant. More research brings the potential of coming closer to full legalization.
Yeah you are incorrect. Hemp cultivation is covered in the 2015 Farm Act. And is regulated by a states Dept. of Agriculture. Farmers can get licenses in states that have adopted the guidelines. Re Brandon16210 and the FDA warning list. I found the FDA warning list (2016) one of the most useful things I have read on CBD. It seemed the FDA were fussing about labelling and claims more than anything. They sent warning letters to CBD companies about non-compliance in this regard. However, they also, very kindly, published a list of test results for quite a few popular companies. Some had no CBD at all in their CBD oil. This seemed to be of no interest whatsoever to the FDA (again, they were in a tiz about the labels) but it is very useful for us consumers. Charlotte's Web was in trouble for the claims they make and for their 'Realm of Caring' website not being transparent about its commercial connections. Personally, the one and only thing I care about in regards to buying CBD products is - what is in the bottle. And, dear Consumer Lab, this is hopefully where you will come in, and give us some guidance. The sooner the better. Please.
