Given the skepticism toward hemp among cannabis consumers (including our survey respondents), we were surprised to see that hemp and marijuana CBD users’ surveys rated their treatments as equally effective. 40% of hemp-derived CBD users with a medical condition find their cannabis products to be extremely effective at relieving their symptoms—compared to 37% of marijuana-derived CBD-only users and 41% of whole plant CBD users. If current CBD users aren’t noticing significant differences in effectiveness, why aren’t they as interested in purchasing hemp-derived CBD products as they are marijuana-derived CBD?


In a recent federal court case, a three-judge panel on the Ninth Circuit sided with the DEA and ruled against the Hemp Industries Association after the agency established a new drug code for “marihuana extract” in 2016. The ruling means that CBD remains a controlled substance. Garrett Graff, the attorney representing the hemp industry in the case, told me that the court opinion did make an exception for Farm Bill hemp, and that it was “not subject to DEA authority,” he said.
“The DEA makes it clear they don’t have to explicitly list anything as a controlled substance as long as a substance is intended for human ingestion, not approved as a drug by the (US Food and Drug Administration), or is structurally or pharmacologically similar to another controlled substance,” he told Leafly. “This DEA rulemaking change doesn’t make it any more illegal” than it previously was. The new rule “was an administrative change,” Armentano added. “It has nothing to do with law enforcement.”
A few lawsuits against large carriers such as Health Care Service Corp. resulted in settlements in which the insurers agreed to revise their coverage policies on residential treatment and other behavioral healthcare services. In addition, there are other pending suits alleging unlawful coverage and reimbursement policies for behavioral healthcare against United, Blue Shield of California, Aetna and Cigna.
CBD does not appear to have any psychotropic ("high") effects such as those caused by ∆9-THC in marijuana, but may have anti-anxiety and anti-psychotic effects.[10] As the legal landscape and understanding about the differences in medical cannabinoids unfolds, experts are working to distinguish "medical marijuana" (with varying degrees of psychotropic effects and deficits in executive function) – from "medical CBD therapies” which would commonly present as having a reduced or non-psychoactive side-effect profile.[10][59]
In the mid-19th century, William Sweetser was the first to coin the term "mental hygiene", which can be seen as the precursor to contemporary approaches to work on promoting positive mental health.[8][9] Isaac Ray, one of the founders and the fourth president [10] of the American Psychiatric Association, further defined mental hygiene as "the art of preserving the mind against all incidents and influences calculated to deteriorate its qualities, impair its energies, or derange its movements."[9]
Another area where the healing effects of CBD are impressive is it’s ability to treat cancer. Unlike chemotherapy or radiation therapies, which destroy not only cancer cells but surrounding healthy cells, CBD effectively chooses cancer cells and gets them to commit suicide. This process is called apoptosis and it is a part of the body’s natural growth cycle. Cancerous cells are immune to this process, except with the intervention of CBD. 

But that’s exactly what happened. According to current federal law, cannabis is considered hemp – not marijuana – as long as no part of the plant (including the leaves and flowers) exceeds a THC concentration of “more than 0.3 percent on a dry weight basis.” Any plant that tops 0.3 percent THC is considered marijuana and is therefore federally illegal to grow, according to Uncle Sam.
It’s pretty easy to tell if recreational marijuana is legal in your state—you can walk into a store and buy it, you drive past 15 pot-leaf billboards on your way to work, and the smell is everywhere. First… hemp, cannabis, marijuana (slang term)… they’re from the exact same plant species – Cannabis sativa. It’s common to mistake hemp and cannabis unless you know why they’re different. The easiest way to tell? If it’s under .3% THC content then it’s hemp and is classified as legal for academic and educational purposes, according to federal law. What is commonly referred to as cannabis (or medical marijuana) contains THC levels above .3% and can extend into levels between 15-30% THC. Remember, THC (tetrahydrocannabinol) is the psychoactive component of cannabis. Without these higher THC levels, there are no psychoactive effects for you.
Arguments for hemp claim that on a molecular level, CBD is identical regardless of the source. Furthermore, prominent hemp-derived CBD producers, such as Medical Marijuana Inc., dispute the claims described above, asserting that their hemp is grown without harmful pesticides and produces cannabinoids that are just as effective at treating medical conditions.
One important thing to clarify is that CBD can be found either in Cannabis plants or hemp. Hemp and marijuana oil fall under the same genus, Cannabis. So marijuana oil refers to either the Cannabis Sativa or Indica plants that are cultivated and grown to produce resinous trichomes. These trichomes contain high levels of tetrahydrocannabinol or THC, so these plants are bred for their psychoactive qualities.
According to the National Eczema Association, “Cannabinoids represent an exciting prospect for the future of AD therapy. With measurable anti-itch, anti-pain, anti-microbial and anti-inflammatory properties, the effect of cannabinoids in patients with AD has already begun to be demonstrated.” (10) Cannabinoids can be found in both cannabis oil and CBD oil.
Marijuana-derived CBD products, on the other hand, don’t enjoy the same luxuries. Because it has been derived from THC-rich marijuana, marijuana-derived CBD, even its isolated from, is considered as a byproduct of marijuana and is judged accordingly. In some states, marijuana-derived CBD is completely legal, while in others, it is completely illegal, but in most states, its a bit of a mixed bag, each state having CBD-specific laws.
Another way to think about the difference between the two plants is by comparing them to roses. There are so many different varieties of roses. They come in various shapes, sizes, and colors. Even though they differ in a great many ways, they are still roses and their genealogy can be traced back to the original rose plant. Much like yellow roses and white roses are to the original red rose, the hemp plant is a relative (a cousin) of the Cannabis sativa plant.

Along with THC, cannabidiol (CBD) is one of more than a hundred “phytocannabinoids” contained in the Cannabis plant. Although treated separately by some, the commonly used categorical schemes include them as mental disorders, albeit on a separate "axis II" in the case of the DSM-IV. A number of different personality disorders are listed, including those sometimes classed as "eccentric", such as paranoid, schizoid and schizotypal personality disorders; types that have described as "dramatic" or "emotional", such as antisocial, borderline, histrionic or narcissistic personality disorders; and those sometimes classed as fear-related, such as anxious-avoidant, dependent, or obsessive-compulsive personality disorders. The personality disorders, in general, are defined as emerging in childhood, or at least by adolescence or early adulthood. The ICD also has a category for enduring personality change after a catastrophic experience or psychiatric illness. If an inability to sufficiently adjust to life circumstances begins within three months of a particular event or situation, and ends within six months after the stressor stops or is eliminated, it may instead be classed as an adjustment disorder. In response to the FDA’s historic decision, the Drug Enforcement Administration (DEA) announced in September 2018 that it had removed Epidiolex from Schedule I classification, a category reserved for dangerous drugs with no medical value. Henceforth, Epidiolex would be considered a Schedule V drug, the least dangerous designation under the Controlled Substances Act.
The high degree of comorbidity between disorders in categorical models such as the DSM and ICD have led some to propose dimensional models. Re Brandon16210 and the FDA warning list. I found the FDA warning list (2016) one of the most useful things I have read on CBD. It seemed the FDA were fussing about labelling and claims more than anything. They sent warning letters to CBD companies about non-compliance in this regard. However, they also, very kindly, published a list of test results for quite a few popular companies. Some had no CBD at all in their CBD oil. This seemed to be of no interest whatsoever to the FDA (again, they were in a tiz about the labels) but it is very useful for us consumers. Charlotte's Web was in trouble for the claims they make and for their 'Realm of Caring' website not being transparent about its commercial connections. Personally, the one and only thing I care about in regards to buying CBD products is - what is in the bottle. If you haven’t been bombarded with CBD marketing or raves about it from friends, get ready. This extract—which comes from either marijuana or its industrial cousin, hemp—is popping up everywhere.
