Even though hemp contains virtually no THC, the answer to the question, “Is hemp oil legal?” is not that simple. As of 2019, CBD derived from hemp is legal nationwide at the federal level. This includes all hemp-derived CBD products like oils, edibles, and ointments. However, some states have laws on CBD from hemp that are restrictive. In some states, CBD derived from marijuana is completely legal; but in most states, its legality depends on a number of different factors and conditions.


Importantly, the farm bill also explicitly allows hemp-derived CBD products to cross state lines. These changes were followed by removal of hemp-derived CBD oil from the federal government’s Controlled Substances Act, meaning it has been decriminalized across the country at the federal level. That grants CBD privileges at the federal level refused, so far, to THC.
Cutting-edge science has shown that the endocannabinoid system is dysregulated in nearly all pathological conditions. Thus, it stands to reason that “modulating endocannabinoid system activity may have therapeutic potential in almost all diseases affecting humans,” as Pal Pacher and George Kunos, scientists with the U.S. National Institutes of Health (NIH), suggested in a 2014 publication.

World War II profoundly affected attitudes towards mental health. The medical examinations of recruits revealed that thousands of apparently healthy adults suffered mental difficulties. In Georgia, for example, the legislature passed a law in 2015 that made legal possession of up to 20 ounces of CBD for patients with qualifying conditions like seizure disorders and multiple sclerosis. Recently, the Georgia legislature passed a compromise law that includes Alzheimer’s disease, AIDS, autism, epidermolysis bullosa, peripheral neuropathy, and Tourette’s syndrome in the list of diseases that can be treated by CBD—as long as that CBD oil has no more than 5 percent THC.

All human rights oriented mental health laws require proof of the presence of a mental disorder as defined by internationally accepted standards, but the type and severity of disorder that counts can vary in different jurisdictions. The two most often utilized grounds for involuntary admission are said to be serious likelihood of immediate or imminent danger to self or others, and the need for treatment. Applications for someone to be involuntarily admitted usually come from a mental health practitioner, a family member, a close relative, or a guardian. Human-rights-oriented laws usually stipulate that independent medical practitioners or other accredited mental health practitioners must examine the patient separately and that there should be regular, time-bound review by an independent review body.[156] The individual should also have personal access to independent advocacy.

Mental health illnesses such as Huntington’s Disease (HD), Tourette syndrome and schizophrenia were believed to be signs of possession by the Devil. CBD has proven neuroprotective effects and its anti-cancer properties are being investigated at several academic research centers in the United States and elsewhere. A 2010 brain cancer study by California scientists found that CBD “enhances the inhibitory effects of THC on human glioblastoma cell proliferation and survival.” This means that CBD makes THC even more potent as an anticancer substance. Also in 2010, German researchers reported that CBD stimulates neurogenesis, the growth of new brain cells, in adult mammals.

Although CBD is not psychoactive, it is not permitted to be sold an ingredient in dietary supplements, as the FDA considers it an investigational new drug. Many a time, multiple cannabinoid compounds are used together, either knowingly or unknowingly.  It is, hence, tough to discern the extent to which each compound is involved in causing the desired effect. There are cases where a group of cannabinoids works synergistically in bringing about bodily reactions. Studies selectively employing CBD oil are few in number, but promising.
Time and budgetary constraints often limit practicing psychiatrists from conducting more thorough diagnostic evaluations.[81] It has been found that most clinicians evaluate patients using an unstructured, open-ended approach, with limited training in evidence-based assessment methods, and that inaccurate diagnosis may be common in routine practice.[82] In addition, comorbidity is very common in psychiatric diagnosis, where the same person meets the criteria for more than one disorder. On the other hand, a person may have several different difficulties only some of which meet the criteria for being diagnosed. There may be specific problems with accurate diagnosis in developing countries.

In September 2018, following its approval by the FDA for rare types of childhood epilepsy,[13] Epidiolex was rescheduled (by the Drug Enforcement Administration) as a Schedule V drug to allow for its prescription use.[14] This change applies only to FDA-approved products containing no more than 0.1 percent THC.[14] This allows GW Pharmaceuticals to sell Epidiolex, but it does not apply broadly and all other CBD-containing products remain Schedule I drugs.[14] Epidiolex still requires rescheduling in some states before it can be prescribed in those states.[65][66]

In 2014, the Farm Bill stated that hemp was different from marijuana, yet the Drug Enforcement Agency’s (DEA) position is that hemp comes from the cannabis sativa plant and as such falls under the controlled substance act. In 2004, the Hemp Industry Association won a court case against the DEA from the Ninth Circuit Court of Appeals that ruled the DEA didn’t have the authority to ban hemp under the CSA. “By that federal court ruling, similar to non-scheduled hemp food products, this allows Medical Marijuana, Inc. (including  HempMeds®) to sell online and distribute to customers in the U.S. states,” said Dr. Stuart Titus, the company’s Chief Executive Officer.”

The mental health policies in the United States have experienced four major reforms: the American asylum movement led by Dorothea Dix in 1843; the "mental hygiene" movement inspired by Clifford Beers in 1908; the deinstitutionalization started by Action for Mental Health in 1961; and the community support movement called for by The CMCH Act Amendments of 1975.[125]

In response to the FDA’s historic decision, the Drug Enforcement Administration (DEA) announced in September 2018 that it had removed Epidiolex from Schedule I classification, a category reserved for dangerous drugs with no medical value. While in all of these states recreational marijuana remains illegal, Connecticut, Delaware, Illinois, Maryland, Minnesota, Mississippi, Missouri, Nebraska, New Hampshire, New York, North Carolina, Ohio and Rhode Island have all decriminalized the drug. In these states, having smaller amounts of marijuana on you won't lead to an arrest or a criminal record. The maximum amount you're allowed to have on your person will vary by state.
Pedini: Well public policy is not a one and done. If that were the case, we wouldn’t have a General Assembly every year. As you know, we can’t always get everything we want in one swoop, so sometimes our progress has to be incremental. Even though hemp contains virtually no THC, the answer to the question, “Is hemp oil legal?” is not that simple. As of 2019, CBD derived from hemp is legal nationwide at the federal level. This includes all hemp-derived CBD products like oils, edibles, and ointments. However, some states have laws on CBD from hemp that are restrictive. In some states, CBD derived from marijuana is completely legal; but in most states, its legality depends on a number of different factors and conditions.

The carrier oils used to create our products will solidify and go cloudy in cold temperatures. It is important to remember that this will not change the quality of the oil or alter its effects. DEA actions have caused “somewhat of a chill in the industry,” said Miller. Not that he's too worried. “The fact of the matter is, (the DEA) have not done any enforcement actions and we believe they never will,” he said. “The instant that the DEA ever seizes a product that was sold on a shelf somewhere that was a Farm Bill product, the next day, we’re going to be in federal court suing them.”
